Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Finding Freedom LLC, doing business as Sales Pipeline Pros ("Company," "I," "me," or "my"), governing your access to and use of the Casino Closer platform, including all related tools, features, and services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Casino Closer is a software-as-a-service (SaaS) platform designed for high-ticket sales professionals, including closers, setters, and customer success managers. The Service provides AI-powered call analysis, deal flow management, portfolio building, CRM integrations, commission tracking, and related productivity tools. The Service is provided on an "as-is" and "as-available" basis.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify me immediately of any unauthorized use of your account.

5. Subscription and Payment

Access to the Service requires a paid subscription. Subscription fees are billed on a recurring monthly basis through Stripe, our third-party payment processor. By subscribing, you authorize recurring charges to your designated payment method. All fees are non-refundable except as expressly stated herein or as required by applicable law. I reserve the right to modify pricing with 30 days' advance notice. Promotional or founding member pricing is subject to the specific terms communicated at the time of the offer.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not: (a) use the Service to upload, transmit, or distribute any content that is unlawful, defamatory, obscene, or otherwise objectionable; (b) attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service; (c) interfere with or disrupt the integrity or performance of the Service; (d) use the Service to engage in any fraudulent, deceptive, or misleading activity; (e) reverse engineer, decompile, or disassemble any aspect of the Service; or (f) use automated systems, bots, or scrapers to access the Service without express written permission.

7. User Content and Data

You retain ownership of all content, data, recordings, and materials you upload or create through the Service ("User Content"). By uploading User Content, you grant me a limited, non-exclusive license to process, store, and display your User Content solely for the purpose of providing the Service. You are solely responsible for ensuring that your User Content does not violate any third-party rights or applicable laws, including recording consent laws in your jurisdiction.

8. AI-Powered Features

The Service includes AI-powered features such as call analysis, scoring, and insights. These features are provided for informational and productivity purposes only and should not be relied upon as professional, legal, or financial advice. AI-generated outputs may contain inaccuracies, and you are responsible for reviewing and verifying any AI-generated content before acting on it.

9. Third-Party Integrations

The Service may integrate with third-party platforms including but not limited to Close CRM, HubSpot, GoHighLevel, Fathom, and Stripe. Your use of these integrations is subject to the respective third-party terms of service and privacy policies. I am not responsible for the availability, accuracy, or functionality of third-party services, and I make no warranties regarding their performance.

10. Intellectual Property

The Service, including its design, features, code, branding, and all related intellectual property, is owned by Finding Freedom LLC. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms. The Casino Closer name, logo, and related marks are trademarks of Finding Freedom LLC.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Finding Freedom LLC and its owner, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the Service, regardless of the theory of liability. My total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

13. Termination

I may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may cancel your subscription at any time through your account settings or by contacting me. Upon termination, your right to use the Service will cease immediately. Sections that by their nature should survive termination shall survive, including but not limited to intellectual property, limitation of liability, and dispute resolution provisions.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Wyoming. You agree to waive any right to a jury trial or to participate in a class action.

15. Changes to Terms

I reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
